BOPEE scam : Produce Mushtaq Peer before Medical Board : HC asks Central Jail authorities
Srinagar, Dec 14 : High Court of J&K and Ladakh Tuesday asked authorities of Central Jail Srinagar to produce former BOPEE chairman Mushtaq Ahmad Peer before the Medical Board for facilitating his medical examination.
Peer was convicted by a special court here in 2018 for his involvement in Common Entrance Test (CET) scam 2012.
Hearing a plea, a division bench of Justice Ali Muhammad Magrey and Justice Mohammad Akram Chowdhary asked senior additional advocate general B A Dar to ensure that Peer is produced before the Medical Board on December 13.
The court said in terms of its order passed on 25.11.2021, the Principal Government Medical College, Srinagar was asked to constitute a Medical Board for facilitating the medical examination of the convict and furnishing of the report.
A communication, the bench said, has been sent by the Medical Superintendent, SMHS Hospital Srinagar, to Superintendent Central Jail, Srinagar asking him to produce Peer before him on December 15 so as to get him examined.
In April 2018, a special anti-corruption court sentenced Peer to a total of 16 years of rigorous imprisonment for his involvement in the 2012 CET paper leak scam.
The court had sentenced Peer to seven years of rigorous imprisonment under 420 of the Ranbir Penal Code (RPC), five years of imprisonment under Prevention of Corruption Act, three years of imprisonment under section 409 of the RPC and one year of imprisonment under section 120B of the RPC.
The Court has however ordered that all the sentences would run consecutively.
The court had also imposed a fine of Rs one crore on Peer and Rs 50 lakh on another accused, Sajad Ahmad Bhat, who was acting as a broker in the scam.
