High Court Stays CAT Order, Asks PSC Not To Finalize Selection
Srinagar, September 10 :
The High Court stayed a Central Administrative Tribunal’s order regarding selection of Range Officer, Grade-I Forest (Territorial) posts after some aggrieved female candidates have challenged constitutional validity of SRO 359 of 1970 with the contention that it prescribes a common height (5 feet 6 inches) for men and women in the selection adding that the SRO is discriminatory in nature.
As against this, the petitioners contended that a number of surveys show that the average height of female is less than average height of male in J&K and therefore, treating “unequals as equals” violates Article 14 and 16 of the Constitution of India.
After hearing, a division bench of Justices Ali Muhammad Magrey and Vinod Chatterji Koul stayed CAT's order& issued notice to government and the PSC for their response to the petition by September 28 with further direction to the respondents not to finalize the selection in question.”
