The government on Thursday issued show-cause notice to 43 teaching and non-teaching employees of the school education department who have been unauthorisedly absent from their duties for the past several years.

Director of School Education Kashmir (DSEK), Tassaduq Hussain Mir said some of the employees including teachers were absent from their duties unauthorisedly from the year 2009.

The director in a show cause notice served to these employees said at least 43 employees of the department including 41 teaching staff and two non-teaching staff members were unauthorisedly absent from their duties for the past several years.

“ Several notices were served by the department, Drawing and Disbursing Officer and the Chief Education Officers concerned to these officials to explain their position for remaining unauthorisedly absent from their legitimate duties.

However, it did not evoke any response in writing or in person from these officials indicating therein their unwillingness to continue in the department,” he said.

Tassaduq Mir said government servants by remaining continuously absent from their legitimate duties attract action as warranted in terms of Article 128 and 113 of Jammu and Kashmir Civil Service Regulations (JKCSR) Volume-I of 1956.

According to Article 128, “absence without leave or after the end of leave involves loss of appointment, while Article 113 states that “after five years of continuous absence on leave, an officer is considered to be an out of state employee.”

The director said that the officials have been asked to explain as to why action as warranted under Article-128 and Article-113 of JKCSR Volume-I of 1956 shall not be taken against them.

He ordered the officials to remain present at DSEK along with a written statement of defense within a period of 15 days from the date of issuance of the notice.

“ If they failed to do so, it shall be construed that they have nothing to say in their defense and action, as warranted under relevant rules, shall be initiated against them without any further notice,” he said.

Meanwhile, a top official at the Directorate of School Education told Rising Kashmir that, “a total of seventy officials of the department have been remaining absent unauthorisedly including the 43 employees who were served show-cause notices.”

He said, “ The department has already stopped their salary and have been asked to explain their position at the earliest.”
